Auto Accident with Pre-Existing Conditions

Initial Situation: Client had a prior back surgery and collected the policy limit from the defendant driver, but the client’s carrier hadn’t responded to the UIM BI demand.

Audit Findings: Vehicle damage documentation showed there were no injury causation concerns and the client’s own carrier had violated multiple portions of the CA Fair Claims Settlement Practices Act in addition to allowing the time limit demand to expire.

Recommendations: Begin to referring client as an eggshell, reference the specific codes believed to have been violated from the CA Fair Claims Settlement Practices Act in addition to the impact severity, and include copies of the supporting documentation.

Outcome: With strengthened documentation, case settled for the UIM BI policy limit shortly after. 

Premises Liability with No Identified Recovery Potential

Initial Situation: Client was injured when an in motion ceiling fan violently fell onto them.

Audit Findings: Located previously unrealized commercial defendant recovery contact information, medical lien, and additional documentation for damages maximization. 

Recommendations: Send a letter of representation to the newly located commercial defendant, provided best practices for disfigurement documentation, lost wages verification, and of medical lien to pursue.

How do I know which service I need?

Schedule a free 30-minute consultation. We’ll discuss your situation and I’ll recommend the most cost-effective approach. Sometimes a quick consultation is all you need; other times a full audit makes more sense.

Can I start with consultation and upgrade to a full audit later?

Absolutely. Many clients start with a one-time consultation to get a feel for how I work, then engage for full audits on specific cases. If you do upgrade within 30 days, your consultation fee is credited toward the audit.

Do you offer payment plans?

For training programs and advisory relationships, yes. For individual case audits, payment is due before work begins.

How quickly can you turn around an audit?

Standard turnaround is 5-7 business days. Expedited service (3 business days) is available for an additional $500.

What if I disagree with your analysis?

I provide my professional opinion based on 23 years of experience, but I’m not infallible. We can discuss areas of disagreement, and I’m happy to explain my reasoning. Ultimately, you decide how to use the information.

About Confidentiality

How do you handle confidential case information?

All files are transmitted and stored using HIPAA-compliant encrypted systems. I sign NDAs as standard practice. Information is never shared with anyone, including anonymized use in training or case studies without your explicit written permission.

What happens to my case files after the engagement?

Files are securely deleted from my systems 90 days after engagement completion, unless you request earlier deletion or extended retention.

About Logistics

Do you work with attorneys outside California?

My expertise is most directly applicable to California cases due to state-specific regulations and my experience with California carriers. However, Colossus and many evaluation methods are used nationwide. Contact me to discuss whether I can help with out-of-state cases.

Can you serve as an expert witness?

I generally don’t serve as an expert witness, as my value is in strategic consulting. However, I can provide referrals to qualified experts and can support your expert witness preparation.

Do you work on contingency?

No. My services require upfront payment or retainer. This ensures I maintain objectivity and can be honest even if the news isn’t what you want to hear.

What if my case settles before you complete the audit?

If you notify me before I’ve substantially begun work, I’ll refund all but a $250 administrative fee. Once significant work is underway, refunds are pro-rated based on work completed.
